Terms and Conditions of Service for Mon Soleil Photography

1. Introduction

Welcome to Mon Soleil Photography. These terms and conditions (“Terms”) outline the relationship between Mon Soleil Photography and its clients (“Client” or “Clients”). By engaging our services, you agree to abide by these Terms. Please read them carefully and contact us if you have any questions.

2. Services and Fees

2.1. Photography Services: Mon Soleil Photography offers photography services, as described in the client’s specific photography package.

2.2. Pricing: The fees for our services are outlined in the client’s proposal or invoice. Payment details and schedules will also be specified therein.

2.3. Additional Costs: Additional costs, such as travel expenses or special equipment, will be discussed with the client and agreed upon before services are provided.

3. Booking and Payment

3.1. Booking: To reserve our services, a non-refundable booking fee is required, as specified in the client’s proposal.

3.2. Payment: Full payment for services is due according to the agreed schedule outlined in the proposal or invoice.

3.3. Cancellation: If the client cancels the photography session or event, the booking fee is non-refundable. Cancellations within [XX] days of the session/event may incur additional fees.

4. Photo Delivery and Copyright

4.1. Delivery: Mon Soleil Photography will deliver the edited and finalized photos within [XX] weeks of the photography session/event. The delivery method will be specified in the proposal.

4.2. Copyright: Mon Soleil Photography retains the copyright to all photos. The client is granted a non-exclusive, personal license to use the photos for personal purposes only. Any commercial use must be discussed and licensed separately.

5. Model Release

5.1. Consent: The client grants Mon Soleil Photography the right to use the photos for promotional and portfolio purposes, unless otherwise specified in writing.

6. Client Cooperation

6.1. Cooperation: The client shall cooperate with Mon Soleil Photography to ensure the success of the photography session/event.

6.2. Rescheduling: If the session/event is rescheduled for any reason, Mon Soleil Photography shall make every effort to accommodate the new date, but no guarantee can be made.

7. Liability and Force Majeure

7.1. Liability: Mon Soleil Photography will not be held liable for any damages or loss, whether direct or indirect, arising from our services.

7.2. Force Majeure: In cases of force majeure (e.g., illness, accidents, equipment failure), Mon Soleil Photography will make reasonable efforts to provide an alternative photographer or reschedule the session/event.

8. Dispute Resolution

8.1. Disputes: Any disputes shall be resolved through negotiation and mediation before seeking legal action.

9. Applicable Law and Venue

9.1. Governing Law: These Terms are governed by the laws of Ontario, Canada.

9.2. Venue: Any legal action arising from these Terms shall be conducted in the courts of Ontario, Canada.

10. Modifications

10.1. Changes: Mon Soleil Photography reserves the right to modify these Terms at any time. Clients will be notified of any changes.
